1. Introduction

Welcome to Monologues-of-89.org (“the Site,” “we,” “us,” or “our”), owned and operated by Nebula Jo (Nëb). These Terms and Conditions (“Terms”) govern your access to and use of the Site, including all text, images, media, products, services, features, and functionality made available through it.

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Site immediately.

2. Intellectual Property Rights

Unless otherwise stated, all original content published on the Site—including text, essays, poetry, written works, graphics, branding, design elements, visual arrangements, original images, original videos, original audio, downloadable materials, digital products, and the overall selection, coordination, and arrangement of Site content (“Content”)—is owned by Monologues-of-89.org and/or its owner and is protected by applicable copyright, trademark, and intellectual property laws.

Not all content referenced, embedded, linked, quoted, or displayed through the Site is owned by us. Certain third-party content, including but not limited to embedded media, music players, videos, platform-hosted content, social media content, and external links, remains the property of its respective owners and is subject to the terms, conditions, and policies of those third parties.

2.3 Acceptable Sharing

You may share short excerpts of written content of up to 50 words for non-commercial commentary, reference, or discussion only, provided that you give proper credit to Monologues-of-89.org and include a direct link to the original page. This permission does not apply to poetry presented in full, premium content, downloadable products, visual works, audio works, video works, or any content marked as restricted or otherwise protected.

3. Third-Party Content, Embedded Media, and Platform Materials

The Site may include or reference third-party content and third-party services, including but not limited to embedded video players, embedded music players, social media posts, streaming content, artist pages, storefront tools, and external websites.

Nothing on this Site should be interpreted as granting you any license or right to use third-party content beyond what is permitted by the original rights holder or hosting platform.

4. Products & Purchases

The Site may offer digital products, physical products, creative works, downloads, or related materials. By making a purchase, you agree to use all purchased materials in accordance with these Terms and any additional product-specific terms provided at the point of sale.

4.1 Digital Products

  • All digital product sales are final unless otherwise stated in a separate posted refund policy
  • No refunds, returns, or exchanges are provided once access, delivery, or download has been granted, except where required by law
  • Purchases grant a limited personal-use license only and do not transfer ownership or intellectual property rights
  • You may not share, distribute, resell, reproduce, upload, repost, or exploit digital products except as expressly authorized in writing

4.2 Physical Products

  • If an item arrives damaged, defective, or incorrect, you must contact us within 7 days of confirmed delivery
  • We are not responsible for shipping delays, carrier delays, customs delays, or delivery issues outside our reasonable control
  • Any replacement, refund, store credit, or other resolution will be handled in accordance with our posted policies and on a case-by-case basis where applicable

5. User Contributions

If the Site allows comments, messages, submissions, reviews, contact form content, or any other user-generated material (“User Contributions”), you remain responsible for the content you submit.

By submitting User Contributions, you represent and warrant that:

  • You own the content you submit or have all rights, permissions, and authority necessary to submit it
  • Your submission does not infringe, misappropriate, or violate any copyright, trademark, privacy, publicity, contract, or other right of any person or entity
  • Your submission is not unlawful, fraudulent, abusive, threatening, defamatory, harassing, obscene, spammy, misleading, or otherwise objectionable
  • Your submission does not include private, confidential, or sensitive information belonging to another person without authorization

We reserve the right, but not the obligation, to review, moderate, remove, refuse, edit, disable, or restrict any User Contributions at our sole discretion and without notice.

By submitting User Contributions, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, store, and use the submission as reasonably necessary to operate, maintain, moderate, and present the Site and its interactive features. This license ends when the content is permanently removed from our active systems, except to the extent retention is required for legal, archival, security, backup, or administrative purposes.

6. Acceptable Use

You agree not to use the Site in any way that could damage, disable, overburden, interfere with, or impair the Site or our ability to operate it. You further agree not to:

We do not guarantee that the Site will be uninterrupted, secure, error-free, accurate, complete, current, or free from harmful components. Your use of the Site is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Monologues-of-89.org, its owner, affiliates, contractors, collaborators, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Site, Content, products, services, third-party links, or embedded media.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Site shall not exceed the greater of $100 USD or the amount you paid to us, if any, during the six months immediately preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless Monologues-of-89.org, its owner, affiliates, contractors, collaborators, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your User Contributions
  • Your violation of any law or the rights of a third party

The Site may contain links to third-party websites, services, products, or platforms. We do not control and are not responsible for the content, availability, policies, security, terms, or practices of any third-party site or service. Accessing third-party links is at your own risk.

11. Termination

We may suspend, restrict, or terminate your access to the Site, in whole or in part, at any time, with or without notice, for any reason, including if we believe you have violated these Terms or used the Site in a manner that could create harm, risk, or legal exposure.

12. Dispute Resolution

You agree to first contact us and attempt to resolve any dispute informally before initiating formal legal action.

If a dispute cannot be resolved informally, the dispute shall be resolved through binding arbitration on an individual basis, except that either party may bring an eligible claim in small claims court. You waive any right to participate in a class action or class-wide arbitration to the fullest extent permitted by law.

Any arbitration shall be conducted in a reasonably convenient forum determined by us, unless otherwise required by applicable law.

13. Governing Law

These Terms and any dispute arising out of or relating to them or the Site shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to conflict of law principles, except to the extent superseded by applicable federal law.

15. Entire Agreement
